CARAVAN ITEMS COVERED

• Chassis members, damper, brake cables, drums only
• Appliances (Fridge, Oven, Heater, Water Heater) – To ensure the appliance can function from ONE power source only.
• Road Lights – Rear light clusters, cables, plugs ( not misuse)
• Gas Leaks – Covers all gas pipes, joints, but not hoses

SPECIFIC EXCLUSIONS

• Tyres, valves
• gas hoses, burners, secondary fuel systems on all appliances
• Any retro fitter accessories
• Water Ingress

MOTORHOMES ITEMS COVERED

• Habitation items are as per above
• The engine is covered for basic functionality including the battery, clutch and drivetrain. Driveshaft gaiters, gearbox seals, and ancillary systems are not covered.

SPECIFIC EXCLUSIONS

• Any problem that does not directly effect the engine running and the drivetrain working.
• Electrical problems of any kind

The warranty is held with Budget Caravans and administered, and underwritten by them. Budget Caravans reserves the right to use secondhand parts to repair any vehicle. Budget Caravans will not re-emburse customers for work done elsewhere unless specifically agreed by the salesman in writing.

If the goods is not ready by that the purchaser may give notice to the seller, in writing, stating that the agreement will be cancelled if delivery is not secured within 7  days, commencing from the actual date of receipt of the notice. In the event in such cancellation, the seller will refund any deposit paid by the purchaser.The seller shall not be liable for damages for non delivery or delivery delayed beyond a reasonable time unless has been both i) fault by the seller and ii) explicit notification at the time of the agreement of the potential financial loss by the purchaser. 

b) the purchaser shall remain bound should taxes increase between the date of the agreement and the date of the delivery. The purchaser shall receive the benefit of any decrease in relevant taxes. 
1a) If you don’t accept delivery of the goods when they are ready – unless we are at fault – we will give you 3 days notice in writing or face to face that the contract is going to be cancelled. 
b) If you change your mind and decide to cancel the contract – unless we are at fault – please tell us as soon as possible in writing. 

We will do all we an do to minimise our losses, but we reserve the right to claim any reasonable amount from you to cover them. The minimum amount this will be is £250.

2  Where the seller agrees to allow part of the price of the goods to be discharged by the purchaser delivering a used motor vehicle or caravan to the seller such allowance is hereby agreed to be given and received and such used vehicle is hereby agreed to be delivered and accepted as part of the sale and purchase of the goods and upon the following further conditions; a) You are the sole legal owner of the vehicle, or have the owners written authority to sell. The vehicle is free from all financial claims by others. If the vehicle is subject to any form of finance you must disclose it and agree with us how it is to be settled – b) If we examine the vehicle before you agree to buy from us , you agree to deliver it in the same condition (fair wear and tear accepted). If we cannot examine it when you agree to buy from us , we will quote you a provisional allowance but reserve the right to change this once we have examined the vehicle. A change in the allowance does not relieve you of your obligation to purchase a vehicle from us. You should therefore let us examine your part exchange in advance. c) If you had over the part exchange before your goods have been delivered by us and then decide to cancel the contract – – Will either return your vehicle or the cash value of the allowance- Will do all we can to minimise our losses, but reserve the right to claim any reasonable amount to cover them – this could be less, equal or more than the deposit.

3 If either party needs to tell the other above anything relevant to this agreement, notification shall be in writing, or shall be confirmed in writing as soon as practicable. 

4 a) Finance is not available from Budget Caravans – You may seek finance from an external party but Budget Caravans will not be liable for any losses if the finance doesn’t complete.

5 a) Title to the goods shad not pass until the seller has received cleared funds for the whole of the purchase price. However, risk in the goods shall pass to the purchaser as soon as they are delivered to the purchaser. 
b) The purchaser’s right to possession of the goods shall cease at whichever is the earliest of the following dates. i) If he not being a company enters into any composition or arrangement with his creditors has a bankruptcy order made against him . Becomes subject to an application for an interim order under section 253 insolvency Act 1986 or has an interim receiver of his property appointed under section 286 insolvency Act 1986. ii) If the purchaser being a company becomes subject of a voluntary arrangement under section 253 insolvency act 1986 is unable to pay its debts within the meaning of section 123 insolvency act 1986 has a receiver manager , administrator or administrative receiver appointed over the undertaking or assets or income or any part of it has passed a resolution for its winding up or has deemed to be a fundamental breach of contract. 

6  The seller for the purpose of recovery of its goods enter upon the premises where they are stored or where they are reasonably thought to be stored and may repossess the same. 

7 The Purchaser shall be liberty to sell the sellers goods at any price not less than the price agreed between the seller and the purchaser. If he sells on his own alterations he shall sell as agent and bailee of the seller in law and inequity and shall hold the proceeds with other monies and shall not pay the cheque or cash thereof into an overdrawn bank account. He shall open a fiduciary account with the banker and advise them that he holds the entire proceeds of sale to a sub purchaser as trustee of the seller and that not until the payment to the seller of the total indebtedness of the purchaser to the seller shall he be entitled to transfer any profits thereof to any other accounts. The seller shall be entitled to any interest earned on the fiduciary account.

8 The following terms and conditions shall apply where the purchaser has required that , prior to delivery, the goods should be subject to conversion , or substantial alterations or additions by third parties chosen by the purchaser. a) The seller does not approve or recommend such third parties. Nor does the seller accept any liability in tort or contract for work done or items supplied by third parties. b) Such liability shall remain exclusively between the purchaser and the third party in all circumstances, even when the cost of the relevant work and items has been incorporated into overall purchase price,c) Nothing herein shall affect any liability for personal injury or death imposed on the seller by law. 

9 All vehicles purchased from Budget Caravans  are sold as  “Repair Required “ . The Buyer accepts that no pre delivery handover is performed  by Budget Caravans or that any warranty is given with the vehicle. The Condition Report available to be seen on the website and hanging in the caravan window has a FULL condition report. A copy of this report will come with the sale contract on the caravan.

10 Any checks into the history and insurance status must be done by the purchaser. A Clear description of any defects on the caravan will be written on the condition Report and shown to the buyer before they are asked to enter into the contract. 
a) If the buyer chooses to have the caravan serviced before collection from Budget Caravans, a separate contract will be entered into between the buyer and The Caravan Gurus which is not linked, tied or associated with Budget Caravans whatsoever. The contract is between the buyer and The Caravan Gurus only and Budget Caravans is under no obligation to dispose of any financial burden attracted by entering into the service contract with The Caravan Gurus.

11 Any term or condition herein that may be ruled void by law whether in whole or part shall be served from this agreement which will otherwise continue to operate.
